Why We Joined the Fight
It has been over two years since Tracy McCarter was wrongfully arrested in March 2020. That night she survived a domestic violence assault during which her abuser died. Despite evidence that she was defending her life, and was providing her abuser with medical care after immediately calling the police, she was arrested and charged with murder. This is not an anomaly. It’s all too common for survivors of domestic violence to be prosecuted for experiencing domestic violence and daring to survive it. According to one study, 90% of women incarcerated in New York prisons report being survivors of abuse.

After Tracy’s arrest, she was jailed on Rikers Island for nearly seven months without an option for release during the height of the COVID-19 pandemic. Due to outside pressure, in September 2020 the former Manhattan DA finally consented to her release on GPS monitoring through an electronic shackle. However, e-incarceration has made it impossible for Tracy to work, seek mental health treatment, or visit her family (including her first grandchild who was born while Tracy was in jail). The newly elected DA has tweeted support for Tracy during his campaign, but has not followed through to drop her charges. We demand Tracy's freedom and call upon the Manhattan DA, Alvin Bragg, honor his word to stop the prosecution of Tracy McCarter and all survivors.

“It feels like a bait and switch. [DA Bragg] said that [he doesn't] believe in her being prosecuted, and yet [the Manhattan DA's] office [continues] prosecuting her. So what’s changed between then and now besides the fact that [he's] in power? I’m four months pregnant, and we just thought this was gonna be over. And so, I’m trying to wrestle with the fact that my mom might not be present for me in the way that I imagined.”

"My mom taught us to do the right thing all the time, not just when it is convenient. Our government leaders should hold themselves to this same standard. If the DA's office was so convinced a crime was committed, why not present all the facts to the grand jury for them to decide? The right thing in this case would clearly have shown that my mom is not guilty of a crime. It should never be a crime to defend your own life. The charges should be dropped. Why we are still fighting this is something I just cannot understand."

“I was three months pregnant when my mom was arrested. My mom couldn’t be with me during my pregnancy. I gave birth while she was not charged, but confined to Rikers [for nearly 7 months]. And now there is at least another two-month delay where my mom still cannot visit or help me out as a new mom of a now 15-month-old. We were hoping that there would be some sort of forward movement, so my mom can clear her name. Dragging this out traumatizes the entire family, not just my mom."

"I was living in San Antonio, TX, when my mom was arrested. When she came home with the ankle monitor, the judge gave her ZERO free time out of her apartment. She couldn't shop for groceries or walk her dog. She moved to a place with a small backyard so she and her dog, Snuffles, could have time in the outdoors. I moved to New York City with her, so at least the dog could have regular walks. It seemed so messed up to me that even though she wasn't convicted of anything, her dog had more freedom than my mom."
